Accommodation Clause

Article 1. (Scope of Application)

  1. Contracts for accommodation service and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any matters not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  2. In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.

Article 2.(Application for Accommodation Contract)

  1. A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
    1. Guest(s) information: name, address, age, Tel., number of guests, sex;
    2. Date of accommodation and estimated time of arrival;
    3. Accommodation rates (regarding the basic accommodation rates on the Table 1)
    4. Age classifications of guests in the same room; and
    5. Other matters deemed necessary by the Hotel;

Article 3. (Registration)

  1. The Guest shall register the following matters with the Check-In System on the day of accommodation:
    1. name, age, sex, address, and contact information (phone number) of the Guest(s);
    2. nationality, passport number, port and date of entry to Japan; and
    3. other matters deemed necessary by the Hotel;
  2. In the case where the Guest intends to pay his/her accommodation charges prescribed in Article 12 by any means other than Japanese currency, such as traveller's check, coupons, or credit cards, these credentials shall be shown in advance at the time of the registration prescribed in the preceding Paragraph.
  3. If a guest is a minor, he/she may not use this service even with the consent of a parent or guardian. If the guest is a minor, this Hotel may contact the person with parental authority to confirm whether or not the person with parental authority has given consent.

Article 4. (Conclusion of Accommodation Contracts, etc.)

  1. The accommodation contract shall be concluded when the application under Article 2 of the accommodation is accepted. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
  2. When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay, prior to their accommodation, an accommodation deposit set by the Hotel within the limits of Basic Accommodation Charges covering the Guest's entire period of stay (if such period is more than three (3) days, three (3) days). The accommodation deposit should be paid no later than the date stipulated by the Hotel at the time the Contract for Accommodation was concluded.
  3. The deposit shall be first used for the Total Accommodation Charge to be paid by the Guest, secondly for cancellation charges under Article 7 and thirdly for reparations under Article 20 as applicable. The remainder, if any, shall be refunded at the time of payment for accommodation as stated in Article 12.
  4. If the Guest falls to pay the deposit by the date as stipulated in Paragraph 2, the hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of Payment of the deposit is specified.

Article 5. (Special Contracts Requiring No Accommodation Deposit)

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.

Article 6. (Refusal of Accommodation Contracts)

  1. The Hotel may not accept the conclusion of an Accommodation Contract under any of the following circumstances:
    1. When the application for accommodation does not conform with the provisions of these Terms and Conditions;
    2. When the Hotel is fully booked and there is no vacancy;
    3. When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation
    4. When any of a to c are deemed to apply to the Guest seeking accommodation:
      1. The person requesting Hotel accommodation is a member of an organized crime group, under Article 2-6 of the Law on Preventing Unreasonable Conduct by Organized Crime Groups (Code 77 issued in 1991), or a related party, under Article 2-2 of said law;
      2. The person requesting Hotel accommodation is a member of an organized crime group or an organization that supports organized crime groups.
      3. The company requesting Hotel accommodation consists of one or more officers who are members of an organized crime group.
    5. When a guest cause serious inconvenience to other guests.
    6. When the Guest seeking accommodation can be clearly identified as carrying an infectious disease;
    7. When the Hotel and/or hotel staff are violently threatened or unreasonably burdened by the Guest;
    8. When a guest repeatedly makes requests that are difficult to fulfill, such as unjust discounts on accommodation charges or unjust room upgrades, among other matters, or when a guest repeatedly makes demands that involve coarse or violent behavior, such as making unreasonable demands over long periods of time or while scolding, through dialogue, phone calls, emails, etc., which impose a burden on the mental and physical health of the employees and necessitate more effort than typically required.
    9. When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes.
    10. When there is an applicable law or regulation that decided by the prefecture in which the Hotel is located.

Article 7. (Right of the Guest to Cancel Accommodation Contracts)

  1. The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
  2. If the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 4 and the Guest has cancelled before payment), the Guest shall pay cancellation charges as listed in the Table 2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 5 has been concluded, the same shall apply only when the Guest is informed of the obligation of payment of cancellation charges in case of cancellation by the Guest.
  3. If the Guest does not appear until 11 p.m. on the day following the accommodation date without advance notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest. (In this case, the Hotel reserve the right to charge to the Guest payment of compensation fee stipulated in the Table 2.)

Article 8. (Right of the Hotel to Cancel Accommodation Contract)

  1. The Hotel may cancel the Accommodation Contract under any of the following circumstances:
    1. When the Guest is deemed liable for conduct and/or has conducted himself/herself in a manner that will violate laws or act against the public order and good morals in regard to his/her accommodation
    2. When any of the a to c are deemed to apply to the Guest:
      1. The Guest is a member of an organized crime group, under Article 2-6 of the Law on Preventing Unreasonable Conduct by Organized Crime Groups, or a related party, under Article 2-2 of said law;
      2. The Guest is a member of an organized crime group or an organization that supports organized crime groups.
      3. The company or group which requested Hotel accommodation consists of one or more officers who are members of an organized crime group.
    3. When the person requesting Hotel accommodation is obviously intoxicated and could cause annoyance to other guests or when a person is behaving in such a manner as to be an annoyance to other guests.
    4. When the Guest can be clearly identified as carrying an infectious disease;
    5. When the Hotel and/or Hotel staff suffers from violent threat or unreasonable. burden from the Guest. Or, when it is acknowledged that similar activity has occurred in the past.
    6. When the Guest repeatedly makes requests that are difficult to fulfill, such as unjust discounts on accommodation charges or unjust room upgrades, among other matters, or when the Guest repeatedly makes demands that involve coarse or violent behavior, such as making unreasonable demands over long periods of time or while scolding, through dialogue, phone calls, emails, etc., which impose a burden on the mental and physical health of the employees and necessitate more effort than typically required.
    7. When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure.
    8. When the cancellation was made in accordance with a municipal bylaw.
    9. When the Guest does not observe prohibited actions such as smoking in bed, tampers with fire-fighting facilities and otherwise breaches Hotel Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid causing fires).
    10. When the Guest conduct the smoking at prohibited place, the nuisance for fire facilities and the deed attacking to Fire Prevention disable.
    11. When the Guest brings or intends to bring any of a through d:
      1. Guns without a license and proper documentation
      2. Firearms or Swords without a license and proper documentation
      3. Malodorous goods
      4. Excessive amounts of goods
      5. Explosive or flammable goods
      6. Animals, insect, etc. (Please contact the Hotel if you will bring an assistance dog)
    12. When the Guest brings property of the Hotel outside or intends to move Hotel property out of the Hotel.
    13. When the Guest intends to make changes to the hotel or its facilities.
    14. When the Guest does not follow any prohibitions stipulated by the Hotel.
  2. If the Hotel has cancelled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not charge the Guest for any of the services during the contractual period he/she has not received. (In this case, the Hotel reserve the right to charge to the Guest payment of compensation fee stipulated in the Table 2.)

Article 9. (Occupancy Hours of Guest Rooms)

  1. The Guest is entitled to occupy the contracted guest room of the Hotel from 3:00 p.m. on the day of arrival to 10:00 a.m. on the day of departure. However, in the case when the Guest is accommodated continuously, the Guest may occupy the guest room all day, except for the days of arrival and departure.
  2. The Hotel may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the guest room beyond the time prescribed in the same Paragraph. In this case, extra charges shall apply as follows: a)20% of the accommodation rate for exceeding 2 hours b)Up to 3 hours: 100% of the room charge (1-day room charge)
  3. After check-out, if the Guest stays in the Hotel’ s facilities such as the lobby for a length of time similar to that of an accommodation, the hotel may request payment. A

Article 10. (Observance of Hotel Regulations)

  1. The Guest shall observe the Hotel Regulations established by the Hotel. The Hotel Regulations are posted within the premises of the Hotel. In addition to the Hotel Regulations posted within the facility, this also includes those clearly indicated in a manner prescribed by the hotel.

Article 11. (Business Hours)

  1. The check-in times vary from site. The check-in times described on each site will be applied.
  2. In principle, we are open 365 days a year. If there are any changes regarding the business hours, it will be notified on each reservation website in advance.
  3. Find the house manual for the emergency contact information.

Article 12. (Payment of Accommodation Charges)

  1. The explanation of accommodation charges, etc. that the Guest shall pay is as listed in the Table 1
  2. As for payment mentioned in the last article, it is supposed to be done in Japanese yen or coupon tickets which can be accepted on booking websites, credit card, electronic money or other alternative ways.
  3. Accommodation charges shall be paid even if the Guest voluntarily does not utilize the accommodation facilities provided by the Hotel.

Article 13. (Liabilities of the Hotel)

  1. The Hotel shall compensate the Guest for damage if the Hotel has caused such damage to the Guest defined in or as a result of nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases where such damage has been caused due to reasons for which the Hotel is not liable.

Article 14. (Personal Information)

  1. This Hotel will handle personal information of the Guest in accordance with the Privacy Policy of this Hotel (https://corp.stay.rakuten.co.jp/privacy.html).

Article 15. (Measures Taken When Unable to Provide Contracted Rooms)

  1. The Hotel shall, when unable to provide contracted rooms, arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
  2. When arrangement of other accommodation can’t be made, notwithstanding the provisions of the preceding Paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the cancellation charges stipulated in the Table 2 and the compensation fee shall be applied to reparations. However, when the Hotel cannot provide accommodation due to causes for which the Hotel is not liable, the Hotel will not compensate the Guest.

Article 16. (Handling of deposited goods)

  1. We cannot keep guests' belongings or valuables including cash.

Article 17. (Custody of Baggage and/or Belongings of Guest)

  1. When the baggage or belongings of the Guest are found after check-out and ownership of the article is confirmed, the Hotel will inform the owner of the article left and ask for further instructions. When no such instructions are given to the Hotel by the owner or when ownership is not confirmed, the Hotel will take measures as following:
    1. Valuables (including cash of 100,000 yen or more and other articles specified in the Enforcement Order of the Lost Property Act): We keep it and pass it to the police within 7 days (including the day when it was found); and
    2. Articles other than Valuables: We take measures in accordance with the Lost Property Act.

Article 18 (Custody of money or other valuables guests)

  1. As for custody of money or other valuables guests should keep them by themselves or may use valuable lockers (safety box) in this property. No matter if guests use safety box or not, we have no responsibility for any loss or damage of money or other valuables unless there is an intention or neglect.
  2. Guests should manage all the belongings or luggage by themselves, including drinks or foods, clothes, amenities which were brought by the guests.

Article 19. (Liability in Regard to Parking)

  1. Our hotel assumes no responsibility for use the parking area. But an accident arising from an intentional act or the gross negligence of the employer, which is the cause of an employment injury cause of parking management.

Article 20. (Liability of the Guest)

  1. The Guest shall compensate the Hotel for damage caused through intent or negligence on part of the Guest.

Article 21. (Use of the Internet connection)

  1. Guests have responsibility for use of the Internet with using Wi-fi service or any other communication method which we provide. Also as for use of the Internet connection by guests, in case we anticipate damage to this property or third parties by an action taken by guests which we judge irrelevant, we may require discontinuance of the Internet connection, or we may charge a reasonable amount for the loss caused to this property.

Article 22. (Cleaning of the Guest Room)

  1. The hotel does not provide daily cleaning even if guests use the same room in succession, but when the guests stay for 4 consecutive nights or more, the hotel provides a cleaning on the day specified by the guest. (Cleaning is done on the second and subsequent nights.) However, cleaning is once every three days at maximum and if special terms are agreed by the guest and the hotel, such terms are applied. In addition, when there is no designation of the cleaning day from guests, in view of the purpose of laws and regulations and prefectural ordinances etc., cleaning starts at the ratio of the minimum interval considered necessary for the survival of the cabin and hygiene management. In addition, we will not change the towels and linens or replenish the amenities during a period when cleaning is not required. Guests cannot refuse any decision on the hotel regarding its minimum number of cleanings required for room survival and hygiene control.

Article 23. (Others)

  1. In the event that a guest has a problem, accident, or other dispute with another guest for reasons not attributable to the hotel, the guest shall resolve the dispute.
  2. In the event that the hotel deems it necessary for the operation of the hotel, the hotel may change the contents of these terms and conditions. In such cases, the hotel shall provide information at an appropriate time and in an appropriate manner in light of the impact of such changes and the operation of the service.
  3. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan, and the Tokyo District Court shall have exclusive jurisdiction as the court of first instance in the event that any legal action is required in connection with these Terms and Conditions
  4. In the event of any inconsistency or discrepancy between these Terms and Conditions and the terms and conditions translated into a foreign language, the Japanese version of these Terms and Conditions shall prevail.

If the cancellation policy is set by each reservation website, the cancellation policy will be applied.
“%” is the ratio of the penalty fee to the basic accommodation charge.
In the event that the contracted days are shortened, a penalty of one day (the first day) will be collected regardless of the number of days shortened.
